Tenants to take legal action against Pelican

PELICAN--The Tenants Association of Pelican Resort Club will be taking legal action against the new owners of Simpson Bay Resort and Marina (former Pelican Resort).

Cura�ao-based attorney Gerrit van Giffen confirmed on Tuesday that his services had been secured to start legal proceedings against the resort.

Van Giffen said he is currently exploring the case to determine the exact course of action to be taken.

"We are trying to find out whether they have a case against the new owner for closing the resort. We are not fully informed as yet, but we feel there is some chance to start litigation to reopen the resort based on the fact that the tenant owners have rights," he said. "They have paid their maintenance fees and they are in good standing."

He said the closure of the resort is a breach of the agreement with tenants. The court action is likely to be filed during the course of this week and will focus on having the resort reopened or having maintenance fees reimbursed.

The resort closed on Sunday. There has not been any official statement from the new owner since the closure.

The closure has left close to 200 workers pondering their fate and hundreds of timeshare investors agonising about their investments.
